Mediation
Mediation is a process for the non-judicial resolution of a dispute through the process of assisted negotiation. The mediator helps both parties discuss their situation, obtain the relevant information required for decision making, and search for creative solutions.
The process is entirely voluntary—any party can leave mediation at any time for any reason—and it does not foreclose other remedies, such as taking the matter to court. However, there can be significant advantages to using mediation as a dispute resolution mechanism over going to court. Costs are usually much lower, and because this is not an adversarial process, but rather a settlement mechanism, both parties are like to emerge from mediation with an agreement they can live with, a win-win situation rather than a win-lose result.
